This Privacy Policy references apply both to Hello Auto App, the company website https://helloauto.com, and the processing of the personal data of our registered users. 

Through this Privacy Policy, we want to inform you clearly about the way we deal with your data and your rights, complying with the new European regulation of protection of personal data REGLAMENTO (UE) 2016/679 (RGPD).

1. Who is responsible for controlling your data?

HELLO INSURANCE deals with the information provided by those people interested in our insurance to be able to grant their request and engage in a contract with the product or service ordered, as the case may be.

For the correct provision of the service ordered, and providing that you have Hello Auto Connect installed in your insured car, we shall process the data collected by the device, only for the management of the insurance contract, the claims management and the correct functioning of the device' specific utilities.

2. Purposes linked to the installation of the Hello Auto Connect device

The main purpose of the HELLO Auto Connect device is to record live and continuously the frontal exterior part of the insured car while driving.

The recordings will be stored on the device Hello Auto Connect, only available to the registered user and permanently (up to maximum storage capacity, which is 8 hours of recordings). The authorised user can download them on his mobile phone via bluetooth.

In the event of a claim, it will be stored automatically on Hello Auto insurance company registers, a recording from the minute before to the minute after the incident.  The sole purpose of this procedure of automatic storage of the recording is the management of the claim itself and the liabilities that may be involved, depending on each case. 

The Company will have access only to those recordings automatically stored on Hello Auto files, as a result of an accident. All other recordings will in no case be accessible to the Company and will be kept exclusively for the private use of the holder.

In the event of a claim, and inmediately after it, the device Hello Auto Connect is also enabled to take a photograph of the interior of the damaged insured car, with the aim of providing the emergency services with an actual image of the condition of occupants inside the vehicle at the time after the accident.

This picture will solely and exclusively be used for the purpose of being sent to the emergency services, not otherwise accessible or used for any other aim. 

Hello Auto is aware that the content of such photograph may be potentially sensitive.  For that reason Hello Auto will apply maximum security measures during its processing, to prevent any third party from gaining access to said image, and avoid its destruction, loss or any other unauthorised access.  Also, to protect the personal privacy of the vehicle's occupants, this photograph will only be available to the claims departament manager with the aim of sending it to emergency services, to ensure a more precise knowledge of the real situation of the people injured after the accident and a more effective action and care.

Consequently, the proccessing of this information is exclusively for the knowledge of the vitals of the injured parties. 

Additionally, Hello Auto is planning to include an optional breathalyser device that will allow users to know the driver's alcohol level. 

The Company will have access to breathalyser test results for claims management purposes only.  This means that only in the event of a claim, the Company will have access to the results of the alcohol tests carried out prior to the claim. Those results will be stored on Hello Auto Connect, being accessible only for the above-mentioned purposes. 

We will also process your data to keep you informed, through different channels, about our activity, offers and and products. 

To that end, we will carry out researches of our customers' habits and tastes on the basis of the information supplied. 

In addition, if customers had explicitly agreed to receive commercial announcements related to our insurance products, automotive sector, repairers and leisure offered by our partners, they will be able to benefit from the best offers for HELLO INSURANCE customers. 

Finally, providing that you had expressly accepted HELLO AUTO to carry out research of your tastes and hobbies, using data from third parties and including public profiles on social networks, to send you commercial comunications meeting your needs,  we will be able to provide you a personalised service, tailoring advertising to your interests and location.

3. For what purposes do we process the data of fleet drivers?

For fleet managers, the Hello Auto Connect device is equipped with a privacy option button that allows to distinguish between driving during working hours and off-duty driving. Nevertheless, the activation of this button will only affect the data relating to the geolocation of the vehicle and external recording when driving. For this reason, and even when the privacy button is activated, the fleet manager will have access at all times to the data relating to the driving performance parameters on the basis of the need and legitimate interest in knowing the driving behaviour of the drivers of his fleet's vehicles.

The Company will give fleet managers access to the data derived from the driving parameters collected on the Hello Auto Connect device, independently whether or not drivers use the vehicle for business or personal reasons (activating the privacy button). However, in no case will these data be linked to the location or geolocation of the vehicle, or to any other parameters that make it possible to determine the time or place at which the driving takes place.

In view of this, the fleet manager will only have access to data relating to driving parameterisation, on a need to know basis the drivers' habits of the fleet in order to provide a more appropriate service to his customers and to ensure the normal usage of their vehicles by authorised drivers.  

The breathalyser test optionally included in the device will also be available for its use by drivers of fleet vehicles with Hello Auto Connect installed.  In these cases, the Company will also be able to access the positive results and make them available to the fleet manager in the private area of their App. Data stored on the devices (both positive and negative results) will be deleted 15 days after their production.

The Company will have no access in other cases different from claims management or the provision to the fleet manager of data relating to a positive alcohol test. 

An additional function is included on the device, especifically for fleets. It consists of taking a photograph of the interior of the vehicle during the breathalyser test. This function allows the Hello Auto Connect camera to take a picture of the passengers compartment while the driver is being breathalysed, for the sole aim of proving that the authorised driver of the fleet vehicle has taken the test and not another person. 

This picture will be stored in Hello Auto Connect, being available to the fleet manager in his private area of the application, upon request to the Company. Hello Auto will process these images exclusively for making them available to the fleet manager if he has requested them in advance. In no other case will the company process the photographs or have access to them for any other purpose.

Stored photographs will be kept on the device for 15 days. During this period, the fleet manager may request them to be sent to his private area of the application. After the period mentioned, the photos will be deleted from the device Hello Auto Connect being no longer accessible to the Company or the fleet manager.

Likewise, and exclusively for fleet management, Hello Auto Connect offers an additional function for those who voluntarily wish to contract it. By taking several photographs, this function allows the fleet manager to know the number of occupants of the vehicle ("control of passengers"). It can prevent journeys being made with occupants covertly and charging them without the knowledge of the fleet manager.

To achieve this objective, photographs will be taken of the interior of the fleet vehicle every 3 minutes while the engine is operating. 

Because the purpose is to determine the number of people in the vehicle but not their identification, photographs will only be stored when more than one occupant is detected. Otherwise, the picture will be deleted.  

Furthermore, in the case of storage in the device, images shall be pixeled in such a way that it will be impossible to identify the individual occupants  personally, only the number of occupants at any given time.

Under the circumstances referred, these pictures will be stored in the individual device. They will be exclusively available to the fleet manager on his applicaton, if previously requested to the Company, which will process them for the sole purpose of making them accessible to the manager in its application. In no other case will the pictures be processed or accessed for any other purpose.

4. For what purposes do we process the data of Hello Auto Connect device users who are not Hello Auto policyholders?

For users of the device who are not insured by Hello Auto insurance, the Company will only have access to the driving parameter data for commercial ends (assessment of risk and sending insurance premium proposals to those who meet the risk parameters accepted by the Company) provided it has previously obtained the express consent of users for the processing of their data for such a purpose. 

Otherwise, the processing will be limited to the proper functioning of the device functionalities expressly contracted by non-insured users.  

5. What kind of processing do we carry out for the assessment of insurable risk? 

Apart from the analysis of the data you provided us during the pricing or contracting process and subject to Hello Auto' s legitimate interest in the proper assessment of insurable risks, we will process the data held on you in Experian' s asset solvency file and in the following files: 

FIVA (Fichero informativo de vehículos asegurados - insured vehicle information file), to find out whether the vehicle sought to be insured by Hello Auto is currently insured or not. 
TIREA SYMCO (fichero histórico del seguro de automóvil - historic file of car insurance), to access the complete and updated history of each car insurance policyholder.

In addition, if you had given us your express consent to do so, we will process the data relating to the file of your traffic fines, included in public sources and official bulletins. Also, we will carry out a credit scoring and a default risk analysis to determine your ability to pay the premium, using external sources such as Experian or Data Thinx, whose information is accessible if you wish on their respective websites. 

That information will be exclusively used with your express consent and only for the assessment of the insurable risk, for the calculation of the premium and/or for the refusal of cover, if applicable. It will not be processed for any purpose other than those established on the first information layer.

6. How long wil we keep your data?

In the case of users of Hello Auto Connect insured by the Company, the data provided will be kept for the duration of the contractual relationship between the parties, as well as for the limitation period of actions derived from the contract with the Company. After this period the data will be blocked unless a shorter period has been specifically established in this Privacy Policy.

In the event of our contract proposal not being accepted, we will retain your data for a period of six months, in order to be able to maintain the conditions of the offer for that period and for the fraud prevention in the contract. 

The geolocation data related to the sending of commercial communications will be kept for the period necessary to fulfil this purpose. Once the commercial communications based on geolocation data have been sent, the Company will proceed to delete and block the data, as well as the concesioned entities, if applicable.  

The geolocation data of a vehicle insured by Hello Auto that has been stolen will be deleted by the Company immediateley after the location has been communicated to the police. 

The interior image of a damaged vehicle will be automatically deleted by the Company, immediately after it has been sent to the emergency services.

7. What is the legitimacy for the proccesing of your data?

The legal grounds for the processing of your data is the consent given for the development and fulfilment of the contract and the provision of the services linked to the Hello Auto Connect device, according to the terms and conditions subscribed to. 

HELLO INSURANCE, as the data controller, is legitimised to send commercial information about the company's products and services. At any time, the customer may express his opposition to this type of processing, in no case will the exercising of this right entail the termination or prevent the proper fulfilment of the contractual relationship that links them to the Company. 

Customer profiling, carried out on the basis of data directly provided by customers, without using third party sources, is based on the legitimate interest of HELLO INSURANCE.

The sending of commercial advertisements about third-party products is based on the express data subject's acceptance to their processing by Hello Auto and its partners for this pupose. 

Access will be made to customers' profiles on social networks for the adaptation of commercial offers to their tastes and interests and the linking of their location data with the intended commercial purposes, when applicable, on the basis of their express consent to the data processing for such a purpose. 

Access to information on traffic fines, penalty points or the carrying out of credit profiling and default analysis with data collected from sources outside the holder's control, will be carried out with the sole aim of assessing the insurable risk and with a prior holder's express consent.

The data subject will have the right to withdraw his or her consent at any time, provided that the processing is not necessary for the contract's performance.  The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
